The judge, who was appointed by President Joe Biden, ruled that the administration’s action cannot be implemented while the case proceeds. In the decision, the judge emphasized that the Supreme Court’s ruling earlier this year constitutes the prevailing legal standard and must be adhered to by the executive branch.
The Supreme Court’s June decision affirmed that the Constitution’s citizenship clause applies broadly to anyone born on U.S. soil, regardless of parental immigration status. The Maryland judge cited that ruling as the controlling authority, stating that the administration’s new order conflicts with established Supreme Court precedent.
Trump’s latest executive order follows a prior attempt to curtail birthright citizenship that was rejected by the Supreme Court. After that rejection, the administration introduced the new measure, which would have imposed additional requirements and restrictions on who could claim citizenship at birth.
By blocking the order, the court has required the White House to halt any enforcement actions related to the policy until the legal challenges are resolved, reinforcing the Supreme Court’s interpretation of the 14th Amendment as the governing law on the matter.
