Hungarian Government to Repeal Orban-Era Restrictions on Gay Adoption

Hungarian Prime Minister Peter Magyar announced on Saturday that his government intends to repeal legislation passed in 2020 that effectively banned adoption by gay and lesbian couples. The move marks a significant shift in policy from the previous administration led by Viktor Orban, who held power for 16 years before being defeated in a landslide election this past April.

Prior to the 2020 legislative changes, same-sex couples in Hungary were able to adopt children if one partner applied as a single person. The law introduced by Orban’s Fidesz party altered this process by requiring that all adoption requests from single individuals receive direct approval from the family affairs minister. This requirement created a bureaucratic hurdle that functioned as an effective ban on adoptions by LGBTQ individuals.

During a press briefing, Prime Minister Magyar stated that the government plans to remove the authority of politicians to intervene in the adoption process. He argued that decisions regarding the placement of children should be made by professionals rather than government ministers. According to Magyar, the goal of the reform is to ensure that children are placed in environments that allow them to grow into happy and harmonious members of society.

The 2020 restrictions were part of a broader legislative agenda pursued by the Orban government, which framed its policies as a defense of traditional Christian values against Western liberalism. During that period, the government also enacted laws that prohibited the legal recognition of gender changes in personal documents and restricted the use of educational materials that were perceived as promoting homosexuality or gender transition.

The proposed changes to the adoption system represent a notable effort by the new administration to restore certain LGBTQ rights in the European Union member state. While the previous government utilized its legislative power to tighten control over family and social policies, the current administration has signaled a move toward a professionalized, non-political approach to child welfare and adoption procedures.
