The decision, issued by Judge Susan Illston in San Francisco, found that the Department of Homeland Security (DHS) overstepped its legal authority by attempting to force the agency to cut thousands of disaster-response positions.
The legal challenge was brought by labor unions representing FEMA employees. The court found that the DHS violated federal law established in the wake of Hurricane Katrina in 2005, which explicitly prohibits the department from significantly or substantially reducing the authorities, responsibilities, or functions of FEMA.
The dispute centered on a directive issued last year that prevented FEMA from renewing the temporary contracts of thousands of on-call reservists who are tasked with responding to national disasters. In her ruling, Judge Illston noted that there was no evidence in the administrative record to support the decision-making process behind this move or the subsequent conditions the department placed on FEMA’s renewal authority.
Judge Illston, who was appointed by President Bill Clinton, did not include specific penalties or remedies in her initial decision. Instead, she indicated that the scope of relief and potential remedies would be determined in a separate ruling scheduled for next month.
The court has invited the involved parties to submit briefings regarding the appropriate scope of relief to be provided to the unions. As of the current ruling, the legal proceedings remain ongoing as the court prepares to address the specific consequences of the department's actions.
