Lawsuit filed following death of pregnant Texas woman

The family of 37-year-old Tierra Walker has filed a lawsuit in a San Antonio state court against Texas Attorney General Ken Paxton, the Texas Medical Board, and the physicians who treated her. The legal action alleges that the state’s near-total abortion ban is unconstitutional and directly contributed to Walker’s death in December 2024.

According to the complaint, Walker was 20 weeks pregnant when she began experiencing symptoms of preeclampsia, a pregnancy complication characterized by high blood pressure. The lawsuit states that Walker sought medical care and requested an abortion, which the family contends was a necessary, life-saving intervention that qualified for an exception under existing Texas law.

The filing claims that despite Walker’s medical emergency, her doctors repeatedly refused to perform the procedure. Instead, she was allegedly sent home multiple times with assurances that her condition would improve. Two days after her final hospital visit, Walker died from complications related to her pregnancy.

The lawsuit asserts that standard medical care for severe preeclampsia often requires the immediate delivery of the fetus or an abortion. By failing to provide this care, the medical team allegedly acted in accordance with a climate of fear created by state officials.

The legal challenge argues that Attorney General Ken Paxton and other state leaders have implemented a blanket prohibition on abortion that intimidates medical professionals. The family claims this atmosphere of intimidation prevents doctors from performing necessary procedures, even when they are legally permitted under the state's narrow exceptions.

The defendants in the case include the state’s top law enforcement official and the Texas Medical Board. The lawsuit seeks to address the constitutional implications of the state's abortion restrictions and the impact those policies have on the medical establishment's ability to treat life-threatening pregnancy conditions.
