Top Sydney judge launches explosive legal action
A senior judge of the NSW Local Court alleges the judicial watchdog unfairly made findings against her after she complained about the chief judge.
First reported 2 hours ago · latest update 2 hours agoHer lawyer says the original decision by the judicial commission to dismiss her complaint about the chief judge made “findings and opinions adverse to her knowledge, credit and conduct”, and “on critical issues concerning her own conduct and good faith”.
Freund was “not afforded a fair opportunity to address the new adverse information supplied in the chief judge’s response” to her complaint, her lawyer says.
Had Freund been given that opportunity, the document said, there was a “realistic possibility” the findings would not have been made.
She would also have sought to adduce evidence and make submissions on issues including cases in which “matters involving relatives of magistrates were dealt with within the Local Court”, the filing says.
NSW magistrates are now known as judges under changes that took effect in March.
